Adoption process turned on its head
For more than four decades, Massachusetts law held that the surrender of a child outside the state was valid “if it was made in accordance with the laws of the state or country in which he or she was executed.” Parents who live out of state can opt for the Massachusetts surrender process, in which the surrender form is signed in front of two witnesses and a notary public at least four days after the birth. However, when Diana Velez Harris took office as First Judge of the Hampshire Probate & Family Court in Northampton, she began reinterpreting the law in February 2023. It now requires that the surrender be valid only if the birth mother physically travels to Massachusetts. Adoption advocates fear the new, more expensive and time-consuming process could be rolled out across the state.
