Chhatrapati Sambhajinagar: The Aurangabad bank of the Bombay Supreme Court has overturned and lifted the criterion of 10% weight versions for recruiting engineers in the Gate scores Maharashtra State Electricity Distribution Company Ltd. (Msedcl), while he describes it as “unreasonable and unconstitutional”. The criterion was introduced into recruitment advertising by corrigendum.
The orders that existed by the HC division, which the judges SG Mehare and Shailesh P Brahme encompassed, have lifted the controversial advertising conditions and instructed the MSEDCL to revise their selection list by excluding 10% gate scores of the candidates.

The MSEDCL, which on December 29, 2023 filled an advertising for 320 positions of the graduate of the graduate trainee (distribution) throughout the state, later introduced a corrigendance, which granted the gate-qualified candidate the weight of the weighted weights. This decision was questioned by the petents, including Nitin Rathod, represented by lawyers Sayyed Bauf Yaseen, who claimed that the provision was not only arbitrary and discriminatory, but also against Article 14 and 16 of the constitution.
The lawyer denied that the weight of the principle of merit by creating a “class within the class” and did not match the classification of service and the recruitment regulations from 2005.
In its detailed observations, the HC stated: “By using the weight, the candidates with Gate score are marching in front of the candidates such as the petent, which defeats the criteria of earnings, which is arbitrary, discriminatory and against the principles of equality.”
The judgment also emphasized that the introduction of this weightage was not supported by changes in the service regulations, which made it not enforceable.
The court also noted the fact that many candidates, including those who have qualified, were already selected on the basis of the original criteria. However, it was claimed that the weight mechanism was incorrect, since the online written test carried out as part of the selection process was sufficient to evaluate the suitability of the candidates.
As a result, the High Court Msedcl instructed a new list of earnings without the benefits of Gate score weightand then issue appointment offers.
